Antes de presentar una queja bajo el Artículo 138

La presentación de una queja bajo el Artículo 138 será notada en el oficial historial militar del oficial al mando, así que no se debe tomarlo a la ligera. Aún antes de que usted pida la recuperación, lo que siempre precede la presentación de la queja bajo el Artículo 138, sugerimos que a la cadena de mando le diga usted que piensa en presentar una petición de recuperación de conformidad con una queja bajo el Artículo 138. En un tono cortés y formal, debe sugerir algo parecido a lo siguiente:

Sir/ma’am, I have been trying to resolve __________ and I know I’m being harmed by __________, and I am thinking of filing an Article 138. I know this is really serious, so I just wanted to speak with you first and see if we can’t work something out.

(Señor/a, he intentado resolver __________ y sé que me perjudica __________, así que pienso en presentar una queja bajo el Artículo 138. Sé que hacerlo es serio y por eso quisiera hablar con usted primero a ver si podemos llegar a una solución.)

Antes de que usted presente una petición de recuperación o una queja bajo el Artículo 138, sugerimos que llame a la Línea directa al 877-447-4487.


Cómo presentar una queja bajo el Artículo 138

La presentación de una queja el Artículo 138 tiene dos pasos:

1. Una petición de recuperación en forma de una carta.

Dirija la petición inicial de la recuperación de la injusticia al oficial del grado más bajo que es un responsable del problema; incluya los cuatro puntos siguientes:

(1) Declare que la carta es entregada según el Artículo 138 del UCMJ.
(2) Describa el problema, junto con toda la documentación disponible, incluyendo las declaraciones de los testigos y, si es apropiado, las referencias a las normas militares que el oficial al mando infringe.
(3) Describa las medidas específicas que pueden ser tomadas para resolver el problema.
(4) Precise una fecha límite para la cual hay que resolver el problema.

Recuerde que dicha carta es en realidad una amenaza, pero no quiere que suene como una amenaza. Quiere que el tono se parece al de “quiero ofrecerle la oportunidad de hacer lo justo para que yo no tenga que presentar una queja”.

2. La presentación formal de la queja bajo el Artículo 138.

Si la injusticia no es tratada y resuelta antes de la fecha límite precisada en la petición inicial, entregue una queja formal. La ley dice que se puede entregar la queja a “cualquier oficial superior con grado de teniente o superior a teniente”. En general, su queja debe subir la cadena de mando hasta llegar al oficial que tiene la autoridad de formarle un consejo de guerra al oficial al que usted pidió la recuperación inicialmente. Se debe ser entregada por la cadena de mando, empezando con su oficial supervisor inmediato (superior).

(1) Declare que “I am officially filing an Article 138 Complaint against _______ [la persona a la que usted dirigió la carta inicial] because of ________ [describa el problema otra vez].” (“Presento oficialmente una queja bajo el Artículo 138 contra _______ porque _______”.)
(2) Describa la respuesta, o la falta de ella, del oficial a la carta inicial.
(3) Precise las medidas que deben ser tomadas para recuperar la injusticia.

No deje de incluir su carta inicial con la que pidió la recuperación además de toda la documentación acreditativa.


El formato de una queja bajo el Artículo 138

EL FORMATO DE LA PETICIÓN DE LA RECUPERACIÓN (presentada antes de presentar la queja bajo el Artículo 138)

TO: Commanding Officer, Unit (A: el oficial al mando, unidad)

(1) Declare que su carta es escrita de conformidad con el Artículo 138.
(2) Describa el problema y la queja detalladamente con declaraciones de los testigos (adjunte las pruebas si es apropiado) y cite las normas militares relacionadas.
(3) Precise la solución del problema y la queja detalladamente.
(4) Precise un marco de tiempo razonable para resolver este asunto.

Por favor, recuerde: Sea cortés y no le amenace a nadie abiertamente. Dar las gracias a la cadena de mando por su tiempo. Saque las copias múltiples.

(1) Declare que presenta oficialmente una queja bajo el Artículo 138 contra _____________.
(2) Mencione la falta de respuesta de la cadena de mando ante la petición inicial de la reparación.
(3) Describa otra vez el problema y la queja y pida que sea tratado y que una orden de reparación sea dado de un oficial más alto.
(4) Describa cualquier abuso cometido en su contra desde la presentación de su petición inicial de la reparación, incluyendo todos los detalles y las declaraciones de los testigos.

ART. 138 of the UCMJ: Complaints of Wrongs

Any member of the armed forces who believes himself wronged by his commanding officer, and who, upon due application to that commanding officer, is refused redress, may complain to any superior commissioned officer, who shall foreword the complaint to the office exercising court-martial jurisdiction over the officer against whom it is made. The officer exercising general court-martial jurisdiction shall examine into the complaint and take proper measures for redressing the wrong complained of; and he shall, as soon as possible, send to the Secretary concerned a true statement of that complaint, with the proceedings thereon.

Army:

AR 27-10, Military Justice (11 May 2016), Chapter 19

Air Force:

AFI 51-505, Complaints of Wrongs Under Article 138, Uniform Code of Military Justice (4 April 2019), defines a “wrong” as:

A discretionary act or omission by a commander that adversely affects the member personally, and that, for example, is:

  • in violation of law or regulation.
  • beyond the legitimate authority of that commander.
  • arbitrary, capricious, or an abuse of discretion.
  • clearly unfair or unjust.

Navy and Marines:

JAGMAN (JAGINST 5800.7G), Manual of the Judge Advocate General (26 JUN 2012), Chapter 3 defines wrongs as:

“Any act, omission, decision or order, except those excluded by subsection 0304, taken, caused, or ratified by a “commanding officer,” under color of that officer’s military authority that:

(1) results in personal detriment, harm, or injury to a military subordinate;
(2) is without statutory or regulatory basis, unauthorized, an abuse of discretion, arbitrary and capricious, unjust, or discriminatory.”

(Article 1150 of Navy Regulations lays out similar complaint procedures for Navy and Marine Personnel to supplement Art. 138)
